These Terms of Use govern your access to and use of CMMC Operator, including our website, newsletters, free resources, paid memberships, templates, workbooks, guides, digital downloads, and related content.

By accessing CMMC Operator or using any CMMC Operator resource, you agree to these Terms. If you do not agree, do not use the site or resources.

These Terms are not legal advice. Have qualified counsel review these Terms before publishing or relying on them.

1. Who We Are

CMMC Operator provides cybersecurity compliance readiness resources, templates, workbooks, and planning materials, with a current focus on CMMC Level 2 and NIST SP 800-171 Revision 2 readiness.

CMMC Operator is an independent publication and resource library. It is not operated by, endorsed by, or affiliated with the U.S. Department of Defense, the Cyber AB, NIST, or any CMMC assessment authority.

2. Readiness Resources Only

CMMC Operator resources are for informational, educational, and planning purposes only.

CMMC Operator does not provide:

  • Legal advice.
  • Certification advice.
  • Official CMMC assessments.
  • Official SPRS scores.
  • C3PAO services.
  • Government approval.
  • DoD, Cyber AB, or NIST endorsement.
  • Audit opinions.
  • A guarantee of compliance.

You are responsible for validating decisions with qualified cybersecurity professionals, legal counsel, assessors, and applicable government or contract requirements.

3. CMMC And SPRS Disclaimer

CMMC, NIST, SPRS, DFARS, CUI, FCI, and related terms are used for educational and readiness planning purposes.

Any score, checklist, template, workbook, guide, roadmap, or assessment output from CMMC Operator is a planning aid only. It is not an official SPRS score, official CMMC certification result, or formal compliance determination.

Current CMMC Operator CMMC Level 2 resources are centered on NIST SP 800-171 Revision 2 because that is the current CMMC Level 2 program baseline. NIST has published SP 800-171 Revision 3, but CMMC Operator resources should not be treated as Rev. 3 assessment materials unless expressly labeled that way.

4. No Sensitive Data

You agree not to submit, upload, paste, email, or otherwise provide sensitive data to CMMC Operator unless we explicitly provide a secure, approved method for that type of data.

Do not provide:

  • CUI or FCI.
  • Evidence files.
  • System configurations.
  • IP addresses.
  • Network diagrams containing sensitive details.
  • Credentials, secrets, passwords, tokens, or API keys.
  • Logs or screenshots.
  • Customer data.
  • Government contract excerpts containing non-public information.
  • Sensitive personal information.

CMMC Operator templates and resources are designed for high-level readiness planning using statuses, owners, dates, categories, and non-sensitive notes.

5. Accounts And Memberships

Some content may require a free or paid membership.

You agree to:

  • Provide accurate account information.
  • Keep your login credentials secure.
  • Not share paid member access with unauthorized users.
  • Not use another person's account without permission.
  • Notify us if you believe your account has been compromised.

We may suspend or terminate access if we believe an account is being misused, shared improperly, used for unlawful purposes, or used in a way that harms CMMC Operator or other users.

6. Paid Memberships And Billing

Paid memberships may provide access to premium guides, workbooks, templates, downloads, updates, and member-only content.

Payments are processed by Stripe or another payment provider. By purchasing a paid membership, you authorize recurring charges according to the plan you select.

Unless otherwise stated:

  • Paid memberships renew automatically.
  • You may cancel future renewals through the available account or billing portal.
  • Cancellation stops future renewals but does not automatically refund prior charges.
  • Access may continue until the end of the paid billing period.
  • Prices and benefits may change with notice.

7. Digital Downloads And Refunds

Digital resources may include templates, workbooks, guides, checklists, ZIP files, spreadsheets, documents, and other downloadable materials.

Because digital products can be accessed immediately, purchases are generally non-refundable unless required by law or expressly stated at checkout.

8. License To Use CMMC Operator Resources

Unless a separate license states otherwise, CMMC Operator grants you a limited, non-exclusive, non-transferable license to use purchased or downloaded resources for your own internal business readiness planning.

You may:

  • Download and use resources internally.
  • Edit templates for your own organization.
  • Use templates to support internal CMMC readiness planning.

You may not:

  • Resell CMMC Operator resources.
  • Redistribute paid resources publicly.
  • Upload paid resources to public repositories.
  • Remove CMMC Operator notices or disclaimers.
  • Represent CMMC Operator templates as your own commercial product.
  • Use CMMC Operator resources to provide paid consulting deliverables to third parties unless you have a consultant or commercial-use license.

Consultants and service providers should contact CMMC Operator for commercial-use licensing.

9. User Content And Feedback

If you send feedback, suggestions, comments, or improvement ideas, you grant CMMC Operator permission to use them without restriction or compensation.

Do not include sensitive data in feedback or support requests.

10. Acceptable Use

You agree not to:

  • Violate any law or regulation.
  • Attempt to access accounts, systems, or content without authorization.
  • Scrape, copy, or harvest content at scale.
  • Circumvent paywalls, membership controls, or access restrictions.
  • Upload malware or malicious content.
  • Interfere with site operation.
  • Misrepresent CMMC Operator materials as official government, assessor, or certification outputs.
  • Use CMMC Operator resources to make false or misleading compliance claims.

11. Third-Party Services

CMMC Operator may rely on third-party services such as Ghost, Stripe, email delivery providers, hosting providers, analytics providers, or file hosting services.

Your use of those services may also be subject to their terms and privacy policies.

CMMC Operator is not responsible for third-party services we do not control.

12. Intellectual Property

CMMC Operator owns or licenses the website, branding, original content, templates, workbooks, guides, layouts, copy, and product structure.

Government standards and public framework references remain owned by their respective sources or are public domain where applicable. CMMC Operator does not claim ownership of official government standards.

You may not copy, modify, distribute, sell, or exploit CMMC Operator content except as permitted by these Terms or a separate written license.

13. No Warranty

CMMC Operator is provided "as is" and "as available."

We do not warrant that:

  • The site will be uninterrupted or error-free.
  • Resources will satisfy any assessor, prime contractor, regulator, or government agency.
  • Templates will make your organization compliant.
  • Content will always reflect the latest law, regulation, standard, or contract requirement.
  • Any readiness result will match an official assessment outcome.

You use CMMC Operator at your own discretion and risk.

14. Limitation Of Liability

To the maximum extent permitted by law, CMMC Operator and its owners, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages.

This includes damages for:

  • Lost profits.
  • Lost business.
  • Failed assessments.
  • Lost contracts.
  • Compliance failures.
  • Data loss.
  • Business interruption.
  • Security incidents.
  • Reliance on templates or planning materials.

To the maximum extent permitted by law, CMMC Operator's total liability for any claim will not exceed the amount you paid to CMMC Operator in the 12 months before the claim arose, or $100 if you paid nothing.

15. Indemnification

You agree to defend, indemnify, and hold harmless CMMC Operator from claims, damages, liabilities, costs, and expenses arising from:

  • Your use of CMMC Operator.
  • Your violation of these Terms.
  • Your misuse of templates or resources.
  • Your submission of sensitive data.
  • Your compliance claims or business decisions.
  • Your violation of law or third-party rights.

16. Termination

You may stop using CMMC Operator at any time.

We may suspend or terminate access if you violate these Terms, misuse resources, abuse membership access, attempt to bypass access controls, or create legal or security risk.

Sections that by their nature should survive termination will survive, including intellectual property, disclaimers, limitation of liability, indemnification, and governing law.

17. Changes To These Terms

We may update these Terms from time to time.

When we make material changes, we will update the "Last updated" date and may provide additional notice where appropriate.

Your continued use of CMMC Operator after updates means you accept the updated Terms.

18. Governing Law And Disputes

These Terms are governed by the laws of [Insert state or jurisdiction], without regard to conflict-of-law rules.

Before filing a claim, you agree to contact CMMC Operator and attempt to resolve the dispute informally.
